Law and the Environment: An Act of Legal Kintsugi?

Abstract
In December 2023, the Law and Society Association of Australia and New Zealand (LSAANZ) convened its annual conference under the theme 'Voice, Resistance, and Repair: Law and living together.' As longstanding collaborators on environmental law, ecological jurisprudence, and Indigenous water justice, we assembled a panel to explore the concept of 'Repair'. Our discussions revealed complex questions about the nature of brokenness in our world and the implications of repair. We grappled with whether repair necessitates a return to a previous state or if it could encompass transformation and even find beauty in fracture, akin to the Japanese art of kintsugi. Given our focus on relationality, particularly the interconnectedness of humans with the broader biosphere, we chose to investigate the notion of 'relational repair' and law's potential role in this process.
Our article, 'Legal Kintsugi', delves into these themes, examining how western environmental law has historically failed to address ecological degradation and exploring alternative paradigms that embrace relationality, pluralism, and dynamic legal performances.
