Generative AI has been integrated into higher education, particularly in legal education. This paper explores the ethical and legal challenges to the intellectual property (IP) that arise from integrating Generative AI in higher education. This reason for exploring the ethical and legal challenges of integrating Generative AI into higher education is to examine the existing IP laws that can address the complexities introduced by AI technologies, such as Blackboard’s AI Design Assistant, powered by Microsoft’s Azure OpenAI Service, into higher education. This paper uses a case study conducted at James Cook University to support this analysis, focusing on publicly available documents that showcase the IP issues related to educational AI tools. These documents highlight the importance of bias, lack of transparency, inaccuracies, and value misalignment. Also, this paper considers Anthology approaches to the lawful, ethical, and responsible use of AI. The central question examined is to what extent the existing IP frameworks are inadequate to handle the legal and ethical challenges posed by generative AI in higher education, particularly in legal education. The necessity for a revaluation of IP laws is to safeguard the contributions of educators and institutions better while promoting innovative teaching practices.Identifying the shortcomings of current IP laws provides essential insights for policymakers, educators, and legal professionals who aim to promote and responsibly develop educational technology. Also, identifying the shortcomings of current IP laws will emphasize amending the legislative frameworks to ensure that IP regulations keep pace with rapid advancements in AI technology. Amending the legislative frameworks will help secure equitable attribution of intellectual contributions and clarify ownership rights.
